Report IP Infringement in Indonesia: New Regulation MoL 47/2025

Ministry of Law Enacted New Regulation Allowing IP Owner or the License Holder to Easily Report Infringing Products and/or Content via DGIP Office

In December 2025, the Ministry of Law enacted new Regulation Number 47 of 2025 (“MoL 47/2025”). Regulation provides new reporting system that allows IP Owner or the License Holder to report any potential infringing product and/or content through the Directorate General of the Intellectual Property Office (“DGIP Office”).

 According to MoL 47/2025, in filing the report of potential IP infringing product and/or content either electronically or directly to the DGIP Office, the IP Owner or the License Holder shall provide the following information:

  1. The identity;
  2. Type, address and/or name of portal, the site, application, or link containing Electronic Information and/or Electronic Documents on the internet network, which is suspected of violating intellectual property rights;
  3. Brief explanation of the alleged infringement;
  4. other information related to goods/services that are suspected of violating intellectual property rights.
  5. Supporting evidence, e.g. mark certificate, license agreement certificate of recordation, etc.

Concerning the timeframe of the report, once the IP Owner or the License Holder completed the filing, DGIP Office will verify the report within 3 (three) working days on examining the report on product and/or content IP infringement, to issue minutes of verification, consideration of the potential IP infringement, and issue a recommendation of the verification result. During the verification process, DGIP Office may reconfirm the content of the report. Any report that satisfies the verification report and proven to infringe the IP Owner or the License Holder, verification team will either a) Partial site closure, b) Full site closure or c) Termination of site access within 1×24 hours.

The DGIP Office will re-open the site and/or allow access to the Electronic System Provider and/or Electronic System User if they submit an application indicating evidence that they have cooperation with or are licensed by the IP Owner and/or reached a settlement with the reporter.
